Wills and Estates

The Law Offices of Joseph Urso can handle all your will and estate planning, the representation of the fiduciaries of decedent’s estates, and the representation of trustees.

Wills and Trusts are the vehicles through which we leave a legacy for loved ones, charities, our alma maters or other organizations that are near and dear to us, after we are gone. These instruments can provide financial security for those we have relied upon in our lives or for those who need our help, and must be drafted correctly in order to achieve our goals. Accounting for the financial consequences of taxes is also critical to end-of-life planning. If not planned for properly, taxes can greatly reduce the amount that loved ones will inherit, but knowledgeable planning can often lessen their impact or eliminate them entirely.

Other end-of-life planning involves deciding who will make our health and financial decisions if we ever become unable to, and what medical measures should be taken to preserve our life.

Finally, when a loved one does leave us, their property and belongings must be legally transferred to their heirs or beneficiaries, whether they had prepared a Will or not. This time and energy-consuming process involves petitioning the Court system, contacting possibly far-flung relatives and providing the Court with much documentation. An experienced attorney can smooth the process, take your mind off the details and allow you to focus on the important things.

Wills & Trusts

The Will is a fundamental tool to ensure that your wishes are followed even after death. Our office can explain the benefits of having a will and then help you to put together one best suited for both you and your family. Our office can also help draft a living and health care proxy (which is essentially a medical power of attorney).

Trusts can be used to help avoid probate, reduce estate taxes and provide comprehensive protection for your children. Our office can help you to draft one, from revocable trust to testamentary trust and irrevocable trusts.

Estate Planning

Clients’ desire to plan for the efficient transfer of wealth, whether during lifetime or at death is an important decision. Our office approaches every wealth transfer strategy with the goal of providing your family with maximum protection against possible litigation and unnecessary taxation. From carefully drafting a will or a trust that offers sound protection against contests and litigation, to sophisticated business succession, tax planning and real estate transactions for estate planning needs.

One of the primary focuses of the firm is in helping clients who are currently facing the probate/administration process. We recognize that this can be stressful and emotionally draining. No matter whether our office is outlining the benefits of probate to put your mind at ease or if helping you with probate administration, you can trust they will be able to help.
